Title: want to know about Labour Law?
Post by: Zahida Raees Raji on August 09, 2005, 08:24:47 PM
Salaam Baasks

I want to know about Labour Law, what is it and how an employee can get benefits from it.

How it can be changed in different firms like private and Government Organizations?

How an employee can bypass organizational policies to claim his labour rights?

Please share your valuable knowledge to slove this public issue.

Regards

RAJI

salam sis

i m not an expert of law.. done one course of business and labour laws ages ago and this is a subjet which is really boring and confusing..... but can comment generally on your questions..

Generally the labour rights are protected in the constitutions with broad rules regarding prohibition of slavery, right to form unions, to enter into lawful employment  and prohibition of discriminations and good working conditions etc

Specifically, In Pakistan labour laws are governed by factory act 1934..payment of wages act 1936..contract of sale acts.. companies ordinance..etcs.... that we inherited from our masters the britishers.. some of the recent legislations are industrial relations ordinance 2002.. there are labour courts for the implementation of labour laws

However,, govt and private companies can make their own policies for employees ... provided they abide the rules and regulations and provisions of constitions and labour laws....

this leads to the second question of ur post... yeah if the policies of the company are in conflict with labour laws then employee can bypass the policies and even can sue the employer on this point....

One last comment....generally the legal system is very deadly slow and it is not cost effective....one should think 100 times before utilising legal route of solving any problem... i may sound naive  making this comment but it is a fact  unfortunately...

thanks sis

Relations of employees and employers are governed by the Ordinance IRO(Industrial Relations Ordinance), under said ordinance the rights and duties of both parties have been mentioned , in clear way . Strike, show -off, hours of work, security measures during works and so on and so forth. Employee can not bypass the policies of the organizational policies except in case of wrongdoing and infringement of employee,s right, constitutional right or any other right but that right must be mentioned in an statute, under the said ordinance an employee can sue and be sued, it is advantageous for the laborers if it is implemented otherwise it is a piece of paper, There are two types of companies one is called private and other one is public, pvt is always written as for as a private company is concerned. There is only difference of capital and members of a company which make a company private or public.
